The Bombay high court on Tuesday, in an interim order, restrained Mhada from handing over 3,000 flats to allotees.

A division bench of Justice J N Patel and Justice R Sondur-Baldota was hearing a public interest litigation filed by an 80-year-old ex-serviceman, who alleged irregularities in the Mhada lottery process. The petition has demanded that all the allotments be scrapped and that Mhada should re-start the entire process. The bench asked Mhada CEO to file a personal undertaking if the housing board wanted the court to lift the stay.

"The court's order will ensure that only genuine persons will have a chance to apply for the Mhada flats,'' said advocate Ahmed Abdi, counsel for the petitioner Gayasingh Yadav. "Once possession of flats was given to the allotees it would have been difficult to turn back the clock.''
